Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

The Cub Cadet® PRO Panel Sweepstakes (“Giveaway”) is sponsored by MTD Products Company, P.O. Box 368022, Cleveland, Ohio, 44136 (“Sponsor”). This Giveaway shall be subject to these Official Rules, and by entering, all participants agree to and are bound by the terms and conditions contained herein and by related decisions of Sponsor which are final and binding.

Eligibility: This Giveaway is FREE to enter and open to all legal residents of the contiguous (48) United States (excluding Florida, and New York) and the District of Columbia who have reached the age of majority in their jurisdiction of residence at the time of entry (“you” and/or “Entrant”). Employees of MTD Products Company, and its respective parent companies, subsidiaries, affiliates, sales representatives, dealers, distributors, licensees or agents, advertising and promotional agencies, and all such employee’s immediate family members and those living in the same household of each such employee, are not eligible to enter or win. Void in Florida, New York, outside of the 48 contiguous United States and the District of Columbia, and where otherwise prohibited or restricted by law. All federal, state and local laws and regulations apply.

Entry Period: The Entry Period for this Giveaway begins on 10/6/2020 at 12:01AM (ET) and ends on 11/15/2020 at 11:59PM (ET) (“Entry Period”). Limit one entry per person.

How to Enter: During the Promotion Period, Entrants must visit the GIE Panel and follow the online instructions provided to register for the PRO Panel.

The Sponsor is not responsible for lost, misdirected or incomplete Entries. Once entered, you may not delete or change your Entry at any time.

Prize: No Prize substitutions will be made by the request of a Winner unless Sponsor, in its sole discretion, determines to do so. Sponsor reserves the right to substitute a Prize in whole or in part with another Prize of comparable or greater value for any reason in Sponsor’s sole discretion. A Prize must be accepted as awarded. Under no circumstances will more than one (1) total Prize be awarded. Sponsor will award one (1) prize as follows:

Total Estimated Retail Value of the Prize is: $7,999.00

Winner Selection: Sponsor will randomly select one (1) winner at the conclusion of the Entry Period from all eligible Entries. If you are selected as a winner, you will be notified by email. If you do not respond to the email notification of your selection as a winner within three (3) days to claim your prize, an alternate winner may be selected to receive the prize at Sponsor’s sole discretion. Contacted winners must respond by email with the following information: 1) first and last name, 2) street address, and 3) telephone number.

Winners are solely responsible for the reporting and payment of all applicable fees, federal, state and local taxes and any other unspecified expenses associated with acceptance or use of Prize. Winner is advised to seek independent counsel regarding the tax implications of accepting a Prize. Sponsor will not award any prize without winner first submitting a fully and legibly completed and accurate IRS W-9 form, and the winner of any prize valued at six hundred dollars ($600.00) or more will be issued an IRS 1099 MISC form in the amount equal to the retail value of the prize. Winners will be required to complete and return an Affidavit of Eligibility prior to Sponsor awarding the prize.

Acceptance of any prize constitutes winner's permission for the Sponsor to use the winner's name, photograph, image, likeness, voice, biographical information, statements and complete address (collectively, the "Attributes"), for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization, and releases the Released Parties from all claims arising out of the use of such Attributes.

Odds: Odds of winning depend on the total number of eligible Entries received during the Entry Period.

Disputes: Sponsor’s decisions are and shall be final in all matters relating to this Giveaway. If a prize notification or a prize is returned as undeliverable for any reason, the prize may be awarded to an alternate winner, at Sponsor’s sole discretion. Prize is not transferable, assignable or redeemable for cash, and winner may not elect to substitute one prize for another. If necessary, a prize of equal or greater value may be awarded at Sponsor’s sole discretion.

Entries that are lost, late, illegible, incomplete, misdirected or incompletely received for any reason, will not be eligible. Sponsor is not responsible for any incorrect, mistranscribed, misdirected or undeliverable Entries, incorrect announcements of any kind, or for any technical or logistical mishaps or difficulties that in any way affect the outcome of this Giveaway or award of the prize. Sponsor reserves the right in its sole discretion to disqualify any Entrant and/or individual it finds to be tampering with the entry process or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision provided herein.

Sponsor reserves the right to modify, extend, suspend, or terminate this Giveaway if Sponsor determines, in its sole discretion, that the Giveaway is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play and/or feasibility of the Giveaway as contemplated herein including without limitation, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure, insufficient number of eligible participants or technical failure.

General Release/Governing Law: By entering, all Entrants release and waive any claim they may have against MTD Products Company and their respective employees, officers, directors, shareholders, affiliates, subsidiaries, parent and related companies, distributors, dealers and agencies and their respective successors and assigns for injuries, claims, damages or losses, costs or expenses of any kind resulting from acceptance of or possession of or arising out of use or misuse of a prize or parts thereof or from participation in this Giveaway. Upon entering this Giveaway, Entrants authorize the use of their contact information for notification of winnings and as described in the Cub Cadet Privacy Policy found at www.cubcadet.com, including updates made from time to time. If at any time you do not wish to continue receiving information from MTD Products Company or you would like to withdraw the personal information you have previously disclosed, please visit www. cubcadet.com and follow the procedures in the CHOICE section of the Privacy Policy. Winner’s name and image may be utilized by MTD Products Company as it deems appropriate and all Entrants authorize the use of their name and image by MTD Products Company accordingly. Acceptance of any prize constitutes prize winner’s permission for Sponsor and/or Sponsor’s designees to use winner’s name and home city and state for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter devised, in perpetuity, without further compensation or authorization (except where prohibited by law), and releases Sponsor from all claims arising out of such use. Liability for any applicable federal, state or other taxes or fees will be the sole responsibility of the winner. This drawing is governed by the laws of the state of Ohio.
